§ 1 Scope of Application
- These General Terms and Conditions apply to all orders placed by you via our online shop (https://shop.pib.rocks).
- These General Terms and Conditions apply exclusively to our offers, orders, deliveries, and further services provided by us. The inclusion of General Terms and Conditions provided by customers that contradict our General Terms and Conditions is hereby rejected.
§ 2 Conclusion of Contract
- The offers in our online shop are directed exclusively at persons who have reached the age of 18.
- The presentation of goods in our online shop represents a non-binding invitation to order the goods via our online shop. It does not constitute a binding offer on our part to conclude a purchase contract.
- By clicking the button "Order with obligation to pay" [„Zahlungspflichtig bestellen“], you submit a binding offer to conclude a purchase contract for the goods displayed in the shopping cart. Prior to placing the order, you can review the contents of the shopping cart once more and correct or change the order.
- As soon as your order has been received by us, you will receive a corresponding confirmation of receipt from us via an automatically generated email. This confirmation of receipt does not yet constitute an acceptance of the offer made with the order to conclude a purchase contract. A contract with us is therefore not yet concluded via the confirmation of receipt.
- In detail, the following technical steps are completed during an order in our online shop:
- Click on the button "Proceed to checkout" [„Weiter zur Kasse“] in the displayed shopping cart;
- Clicking on the button "Proceed to checkout" [„Weiter zur Kasse“] redirects to the general order page, on which the individual purchase steps are subsequently completed;
-
Step 1: Selection of the "Billing and delivery address" (in case you do not have a customer account and are not logged in; otherwise billing and delivery addresses are already stored);
- Entering the billing address
- If billing and delivery address are not identical, you can check the checkbox to "enter a different delivery address"
- Step 2: Selection of payment method and shipping method;
- Step 3: All products in the shopping cart are displayed in an overview; there is the possibility to change the contents of the shopping cart and correct any entry errors;
- Step 4: Completion of the order by clicking the button "Order with obligation to pay" [„Zahlungspflichtig bestellen“].
- A purchase contract for the ordered goods is only concluded once we have expressly declared acceptance of the order or once we have dispatched the goods to you. Your order can only be accepted by us up to the point in time at which you can, under normal circumstances, expect to receive a response from us. If payment is made in advance (bank transfer) or via PayPal, the purchase contract is concluded, in deviation from this, directly upon your order.
- Prior to conclusion of the contract, you have the opportunity to save the contract text including these GTC. After conclusion of the contract, the contract text is no longer accessible to you, but will be stored by us.
§ 3 Right of Withdrawal for Consumers
(1) Consumers (within the meaning of § 13 BGB) are entitled to a statutory right of withdrawal for distance selling contracts. For customers who are entrepreneurs within the meaning of § 14 BGB (B2B), no right of withdrawal exists.
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.
Exercise of the Withdrawal
To exercise your right of withdrawal, you must inform us:
isento GmbH
Ostendstraße 242, 90482 Nuremberg, Germany
Phone: +49 911 21 77 38 70
Email: info@isento.de
by means of a clear statement regarding your decision to withdraw from this contract. You have the following equivalent options for this purpose:
- By post or email: You can send us an informal notification by post or by email.
- By model withdrawal form: You can use the attached model withdrawal form below or download it here as a PDF (the use of the form is however not obligatory).
- Electronically via our website: You can also submit your withdrawal directly via the electronic form Withdraw from contract or the withdrawal button on our website. If you make use of this option, we will immediately transmit to you (e.g. by email) a confirmation of receipt of the withdrawal.
To meet the withdrawal deadline, it is sufficient for you to send the notification concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have sent back the goods, whichever is the earlier.
You must send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you dispatch the goods before the period of fourteen days has expired. We shall bear the costs of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Exclusion or Premature Expiry Grounds
The right of withdrawal does not exist for contracts for the delivery of goods:
- that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive, or that are clearly tailored to the personal needs of the consumer;
- that have been inseparably mixed with other goods after delivery due to their nature;
- audio or video recordings or computer software in a sealed package, if the seal was removed after delivery.
(2) If you return ordered goods to us within the withdrawal period without any further declaration, we will understand this as a declaration of withdrawal.

§ 4 Prices and Payment
- The prices stated in our online shop include statutory value added tax and any other price components, plus the respective shipping costs. Precise information on the applicable shipping costs can be found on our website under Shipping and Payment.
-
Payment can be made optionally using one of the following payment methods:
- Credit card
- PayPal
- Prepayment (bank transfer)
- The selection of the respective available payment method is determined by us. We reserve the right in particular to offer you only selected payment methods, for example to secure our credit risk in certain cases.
- If you pay with PayPal, you will be redirected to the website of the provider PayPal during the order process. In order to make a payment via PayPal, you must register with the provider PayPal.
§ 5 Delivery
- Unless agreed otherwise, delivery of the ordered goods is made from our warehouse to the address specified by you.
- The specific delivery time for the respective item can be found directly on the respective product detail page. Unless another period is specified in the respective offer, delivery of the goods with our shipping service provider DHL takes place within Germany and to other member states of the European Union (EU) within 2 to 7 business days after conclusion of the contract (in the case of agreed advance payment, after the time of your payment instruction). Deliveries to countries outside the European Union (third countries) shall only take place upon separate individual agreement; the applicable delivery time will be communicated to you individually prior to conclusion of the contract.
- We do not assume the procurement risk of having to procure an ordered product. This also applies when ordering goods described only by their type and characteristics. We are only obligated to deliver from our stock of goods and the goods ordered by us from our suppliers.
- We are entitled to withdraw from the contract if, despite the prior conclusion of a congruent covering transaction, we are not supplied properly or in a timely manner by our supplier, and we are not responsible for the lack of availability of goods pursuant to § 9. We will inform you immediately if the ordered goods are not available in a timely manner and, in the event that we wish to withdraw from the contract as a result, will exercise the right of withdrawal immediately. In the event of withdrawal, we will immediately refund any payments already made by you.
§ 6 Retention of Title
We retain ownership of the goods until full payment of the purchase price.
§ 7 Set-off and Right of Retention
- You only have the right to set-off for claims that are undisputed or have been legally established, unless the counterclaim is based on a defect in the same goods (warranty claim).
- You can only exercise a right of retention insofar as it is based on the same contractual relationship.
§ 8 Warranty
Your claims for warranty in the event of defects are governed by statutory provisions.
§ 9 Liability
- We are liable without limitation for intent and gross negligence, including intent or gross negligence of our representatives or vicarious agents, and for culpable injury to life, body, or health.
- Otherwise, we are only liable under the Product Liability Act, in the event of culpable breach of material contractual obligations, whose fulfillment enables the proper performance of the contract in the first place and on whose compliance you may regularly rely, or insofar as we have fraudulently concealed the defect or assumed a guarantee for the quality of the goods. In the event of culpable breach of material contractual obligations, liability is limited in amount to the foreseeable damage typical for the contract at the time of contract conclusion, the occurrence of which must typically be expected.
- An alteration of the burden of proof to the disadvantage of the customer is not associated with the above provision.
§ 10 Alternative Dispute Resolution
- The European Commission provides an online platform for out-of-court dispute resolution (ODR platform). You can reach the dispute resolution platform under the following link: https://ec.europa.eu/consumers/odr.
- isento GmbH is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
- In the event of a disagreement arising from our contract, we strive to resolve it with you amicably. Furthermore, we are not obligated to participate in dispute resolution proceedings and do not participate in dispute resolution proceedings before a consumer arbitration board.
§ 11 Final Provisions
- The contract language is exclusively German.
- For contracts concluded under the applicability of these GTC, German law applies exclusively, excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG, "UN Sales Law"). Mandatory consumer protection regulations of the country in which you have your habitual residence remain unaffected by this choice of law.
- Should individual provisions of these terms be or become invalid, the validity of the remaining provisions shall not be affected thereby.
